Terms of Service

These Terms of Service ("Terms") govern your use of the Forge Ascend mobile and web applications (the "Service"), operated by Ismael Caria ("Forge Ascend", "we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service. By using it, you represent that you meet this requirement.

2. Your account

• You are responsible for the accuracy of your account information.
• You are responsible for keeping your password secure and for all activity under your account.
• One person per account; do not impersonate others.

3. Your content

You own the content you create on Forge Ascend — your workouts, captions, photos, videos, comments, and profile ("Your Content"). By posting, you grant us a limited, non-exclusive, royalty-free license to host, store, and display Your Content solely to operate the Service (for example, showing your posts to your followers according to your privacy settings). This license ends when you delete the content or your account.

• You are responsible for Your Content and must have the rights to post it.
• Visibility follows your settings: public profiles are visible to other users; private profiles share content only with approved followers.

4. Community rules

You agree not to post content that:

• Is illegal, threatening, harassing, hateful, or defamatory.
• Is sexually explicit or exploits minors in any way.
• Infringes someone else's intellectual property or privacy.
• Is spam, scams, or deceptive practices.
• Promotes dangerous activities, self-harm, or violence.

The Service includes tools to report content and block users. We may review reports and remove content or suspend accounts that violate these rules, at our discretion and without prior notice.

5. Health and fitness disclaimer

Forge Ascend provides fitness tracking and training information. It is not medical advice. Consult a physician before starting any exercise program, especially if you have a medical condition or injury. Physical training carries inherent risks — including the risk of injury — and you voluntarily assume those risks when you train. Training programs, recovery protocols, and exercise demonstrations in the Service are provided for informational purposes only; you are responsible for exercising within your own abilities and with proper form and equipment.

6. Our property

The Service — including its software, design, branding, logos, training programs, and exercise library — is owned by Forge Ascend and protected by intellectual property laws. These Terms do not grant you any right to use our branding or to copy, modify, or redistribute the Service.

7. Acceptable use

• Do not attempt to breach, probe, or overload our systems.
• Do not scrape, harvest, or collect other users' data.
• Do not reverse-engineer the Service.
• Do not use the Service to violate any law.

8. Free service and future paid features

The Service is currently free to use. We may introduce optional paid features or subscriptions in the future; if we do, pricing and terms will be clearly presented before you are charged, and these Terms will be updated accordingly.

9. Termination

You can stop using the Service and delete your account at any time from Settings → Delete Account. We may suspend or terminate accounts that violate these Terms. Upon termination, your content is deleted as described in the Privacy Policy.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, Forge Ascend will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service — including injuries related to physical training. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred US dollars ($100).

11. Governing law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in South Carolina.

12. Changes to these terms

We may update these Terms as the Service evolves. If we make material changes, we will notify you in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
